Policy update notice

With this release, we stop separately collecting original story text for research and emailing it to the operator. Topic analysis retains only overall mention totals for predefined general keywords, including repeated mentions. The statistics do not store original text, individual records, or links to orders. Earlier research material has not been automatically deleted.

We are clarifying result and gift retention, the providers we use, and records stored separately. The permitted use of results, prices and refund rights remain unchanged. Current documents continue to apply until their replacement dates. The upcoming documents are available below. No additional consent checkbox is added.

Service access lasts 48 hours for ordinary results and 14 days for gift copies. Storage cleanup starts after expiry. Older versions become eligible for deletion after seven days, followed by another seven days of recovery protection. Cleanup is asynchronous and may take longer. Recovery copies do not extend access or permit new generation.

📄 Terms of Service

Article 1 (Purpose)

These Terms govern the conditions and procedures for using the MY Music Gacha service (the "Service") operated by 지구808뮤직 (the "Company"), and the rights, obligations, and responsibilities of the Company and users.

Article 2 (Definitions)

① "Service" means the AI generation and delivery of a song (lyrics and audio) and an optional photo slideshow video based on the topic, mood, and other inputs you provide. ② "User" means anyone who uses the Service under these Terms. The Service is provided on a one-time basis without account registration. ③ "Input Content" means the topic, mood, photos, and videos you enter or upload. ④ "Results" means the song, lyrics, and video generated from your Input Content.

Article 3 (Posting and Amendment of Terms)

① The Company posts these Terms where users can easily review them. ② The Company may amend these Terms within the limits of applicable law, stating the effective date and reason, and will give notice at least 7 days in advance (30 days for changes that are unfavorable or material to users). ③ If you do not agree to the amended Terms, you may stop using the Service.

Article 4 (Description of the Service)

① The Service is paid; fees and payment methods are as shown on the checkout screen. ② Payment is processed via the payment gateway Korea PortOne Co., Ltd. (PortOne) — Korean simple-pay/card or overseas payment (e.g., PayPal). Generation begins only after payment is confirmed. ③ Fees may vary by selected option (e.g., quality tier) and are shown inclusive of applicable VAT.

Article 6 (User Obligations and Prohibited Acts)

You must not: 1. Input or upload anything that infringes others' copyright, likeness, or reputation; 2. Name, imitate, or reproduce real artists, groups, or existing recordings; 3. Request illegal, obscene, violent, discriminatory, or hateful content; 4. Request inappropriate content involving minors; 5. Use automated means for abnormal bulk use or to disrupt the Service; 6. Upload photos or videos you do not have the rights to.

Article 7 (Rights in Results and Limits of AI Output)

① You may freely use Results that you lawfully paid for and generated for personal purposes, and the Company will not charge any additional usage fee for such use. ② Commercial use of the Results is at your own discretion and risk; the Company does not warrant that commercial use is permitted. ③ Results are produced through external AI engines (for lyrics, music, images and the like). Whether, and on what conditions, the Results may be used commercially is governed by those external providers' terms of service and by applicable law. Those providers may change their policies without prior notice, and the Company is not responsible for restrictions on the scope of use arising from such changes. ④ Due to the nature of AI, similar or identical Results may be generated for other users; the Company does not guarantee you exclusive rights in the Results. ⑤ Intellectual property in the Service's software, lyric/music engines, templates, and design belongs to the Company or its rightful licensors. ⑥ Whether AI-generated Results qualify for copyright protection follows applicable law and precedent; the Company makes no warranty thereon.

Article 8 (Storage and Deletion of Content)

① Results and uploads are retained only for 48 hours after generation for delivery purposes, then automatically deleted. ② You may request immediate deletion at any time during this period, and the Company will process it without delay. ③ Recovery is impossible after automatic deletion, so please download your Results within the retention period.

Article 9 (Limitation of Liability)

① The Company does not warrant the quality, accuracy, completeness, or fitness for a particular purpose of AI-generated Results. ② The Company is not liable for delays or interruptions caused by force majeure or by failures of third-party AI, music, email, or cloud providers, absent the Company's intent or negligence. ③ However, if Results are not generated due to the Company's system or an external engine failure after payment, the Company will re-generate at no additional cost or refund per the Refund Policy. ④ The Company does not warrant uninterrupted or error-free service.

Article 10 (Changes and Suspension)

The Company may change or suspend all or part of the Service for operational or technical reasons, with prior notice for material changes. No separate compensation is provided for changes to features offered free of charge.

Article 11 (Eligibility and Age)

The Service is available only to those aged 14 or older. Children under 14 may not use the Service, and the Company may restrict use found to be by a person under 14.

Article 12 (Governing Law and Disputes)

① These Terms and use of the Service are governed by the laws of the Republic of Korea. ② The Company and users will resolve disputes in good faith; failing agreement, the Act on Consumer Protection in Electronic Commerce and other applicable laws and customs apply.

🔒 Privacy Policy

1. Personal data we collect

We collect the minimum necessary to provide the Service: · (Required) Email address — to deliver results and verify your identity · (When using photo/video upload features) Photos/videos you upload — to create the slideshow video · (Required) Topic, mood, and other text you enter — to generate the song and lyrics · (Continuing after payment) Your story, song settings, selected candidates, edited lyrics and current step — to restore the same project · (When using gift features) Sender and recipient email addresses, names, and gift messages · (Transaction records) Order ID, product, tier, amount, currency, email, payment provider and reference, payment, use and supply-completion dates, and stored consent information · (Automatic) Payment-related data handled by the payment processor, usage records, access logs, consent dates and policy versions linked to your email We do not store payment instrument details (e.g., card numbers); these are handled by the payment processor.

2. Purpose of collection and use

· Generating Results (song/video) and delivering them by email · Verifying your identity by email and checking usage records · Restoring progress on the same project after payment · Analysing usage trends through overall mention totals for predefined topic keywords · Meeting legal obligations and handling disputes

3. Retention period

① Ordinary results, uploads and email-matching data used for result delivery have a service availability period of 48 hours after completion. Gift copies and gift details (sender and recipient email addresses, names and messages) have a service availability period of 14 days after gift creation. Access through the Service ends when that period expires, and storage deletion begins. ② However, transaction and payment records required by laws such as the Act on Consumer Protection in Electronic Commerce are retained for the legally mandated periods: · Records of contracts or withdrawal from a purchase: 5 years · Records on payment and supply of goods: 5 years · Records on consumer complaints or dispute resolution: 3 years ③ Email-linked usage records are retained for the most recent 30 days. Email addresses, consent dates and policy versions are stored as separate consent records and used for one year to determine whether renewed consent is needed. Consent records currently have no automatic time-based deletion. ④ For topic-usage analysis, we retain only overall mention totals for predefined general keywords in entered topics. Repeated mentions are counted, and mentions of different categories are added to their respective totals. A non-empty topic matching none of the predefined categories contributes once to the “Other” total. Mood text and empty topics are not used in these statistics. Earlier totals counting how many topics contained each category are preserved separately and are not combined with the new mention totals. The statistics do not store original text, words outside the predefined list, input examples, customer identifiers, individual submission times, submission order, or combinations of categories appearing together. They are not linked to individual orders or customer records. We do not separately collect original text for research or email it to the operator for these statistics. ⑤ Pre-payment drafts are available for 48 hours from order creation. Drafts, progress and link authentication data for continuing after payment are available for 48 hours from the first payment confirmation. Access then ends and cleanup begins; recovery copies are removed as described in Section 7. Saving progress or opening the link does not extend this period. Lyric-generation, lyric-review and payment records are managed separately from these drafts.

4. Service providers and third-party disclosure

We use the following providers to process personal data only as needed to provide the Service, not for other purposes: · AI lyric/song/image generation: Google, KIE, OpenAI, xAI · Result notification emails: Brevo · Server/storage infrastructure: Google Cloud Platform · Payment processing: Korea PortOne Co., Ltd. (PortOne — payment integration processor) and payment gateways (KG INICIS, PayPal, etc.) We do not provide personal data to third parties except as required by law or with your separate consent.

5. Overseas transfer

In using the above AI, cloud, and email services, your inputs (email, photos, text, etc.) may be transferred to and processed on servers located outside Korea. The items transferred are as in Section 1, at the time of your generation request or result notification email. The purposes are generating and delivering Results and restoring progress on the same project. Topic-keyword statistics do not involve separate AI requests or research emails to the operator. Your consent to this Policy constitutes consent to such transfer.

6. Your rights

You may at any time request access to, correction, deletion, or suspension of processing of your personal data. Access to ordinary results/uploads ends 48 hours after completion; access to gift copies/recipient emails ends 14 days after gift creation. Storage deletion then begins. Recovery copies are removed as described in Section 7. You may request earlier deletion at earth808music@gmail.com beforehand, and we will act without delay.

7. Destruction procedure

Once the service availability period ends, access through the Service ends and storage deletion begins. Older object versions become eligible for automatic deletion seven days after they are replaced or deleted. Copies then remain protected by the storage provider's recovery feature for another seven days before permanent removal. Automatic cleanup is asynchronous, so processing delays or errors may postpone actual removal. These copies do not grant new generation rights or extend access to expired results. See Section 3 for how consent records and overall topic-keyword counts are stored.

8. Cookies

We use the minimum cookies necessary to provide the Service (e.g., language setting, access handling). You may refuse cookies in your browser settings, though some features may then be limited.

9. Notice regarding input topics

The topic and mood you enter are used to generate your song and restore progress on the same project. Topic-usage trends are analysed only through overall mention totals for predefined general keyword categories. We do not store words outside that list or classify names, contact details or sensitive information as statistical categories. Please avoid entering personal or sensitive information that is unnecessary for generation. See Section 3 for how data is stored.

11. Duty to notify

Any additions, deletions, or revisions to this Policy will be announced via the Service at least 7 days before they take effect.

💳 Refund & Cancellation Policy

Effective date: 2026-10-18

1. Nature of the digital content

The songs, lyrics, and videos provided are made-to-order digital content generated individually and immediately upon payment, according to your order (topic and options).

2. Restrictions on cancellation and refunds

Under Article 17(2) of the Korean Act on Consumer Protection in Electronic Commerce, cancellation and refunds are restricted for digital content made to your order once creation has begun. The Company discloses this on the checkout screen in advance and proceeds only after obtaining your consent (checkbox). Checking this box means you agree to the restriction on your right to cancel the purchase.

3. When refunds are available

Refunds are available when: 1. Generation has not started after payment; 2. Results are not generated due to the Company's fault, such as a system or external engine (AI/music server) failure — in which case you may choose between generation at no additional cost and a full refund; 3. The delivered Results materially differ from what was described or advertised.

4. Refund procedure and timing

① Request a refund at earth808music@gmail.com; the Company processes it after verifying the facts. ② Refunds are made to the original payment method and may take about 3–5 business days depending on the payment processor. ③ Late-refund compensation may be added as required by law.

5. Disclosures and consumer protection

Matters not specified here — the period, method, and effect of withdrawal, and the conditions and procedures for refunds — follow the Korean Act on Consumer Protection in Electronic Commerce, related laws, and the Consumer Dispute Resolution Standards.
