Article 1 (Purpose)
These Terms govern the conditions and procedures for using the MY Music Gacha service (the "Service") operated by 지구808뮤직 (the "Company"), and the rights, obligations, and responsibilities of the Company and users.
Article 2 (Definitions)
① "Service" means the AI generation and delivery of a song (lyrics and audio) and an optional photo slideshow video based on the topic, mood, and other inputs you provide. ② "User" means anyone who uses the Service under these Terms. The Service is provided on a one-time basis without account registration. ③ "Input Content" means the topic, mood, photos, and videos you enter or upload. ④ "Results" means the song, lyrics, and video generated from your Input Content.
Article 3 (Posting and Amendment of Terms)
① The Company posts these Terms where users can easily review them. ② The Company may amend these Terms within the limits of applicable law, stating the effective date and reason, and will give notice at least 7 days in advance (30 days for changes that are unfavorable or material to users). ③ If you do not agree to the amended Terms, you may stop using the Service.
Article 4 (Description of the Service)
① The Company provides: 1. One AI song generation per order, based on your topic and options; 2. Optional generation of a photo slideshow video using the song; 3. Delivery of results by email and a time-limited download link. ② One payment equals one generation. Re-rolls, rewrites, and retries are not provided (except for Company-attributable failures under Article 9). ③ Results and uploads are automatically deleted from the server 48 hours after generation.
Article 5 (Fees and Payment)
① The Service is paid; fees and payment methods are as shown on the checkout screen. ② Payment is processed via the payment gateway Korea PortOne Co., Ltd. (PortOne) — Korean simple-pay/card or overseas payment (e.g., PayPal). Generation begins only after payment is confirmed. ③ Fees may vary by selected option (e.g., quality tier) and are shown inclusive of applicable VAT.
Article 6 (User Obligations and Prohibited Acts)
You must not: 1. Input or upload anything that infringes others' copyright, likeness, or reputation; 2. Name, imitate, or reproduce real artists, groups, or existing recordings; 3. Request illegal, obscene, violent, discriminatory, or hateful content; 4. Request inappropriate content involving minors; 5. Use automated means for abnormal bulk use or to disrupt the Service; 6. Upload photos or videos you do not have the rights to.
Article 7 (Rights in Results and Limits of AI Output)
① You may freely use Results that you lawfully paid for and generated, for personal or commercial purposes. ② Due to the nature of AI, similar or identical Results may be generated for other users; the Company does not guarantee you exclusive rights in the Results. ③ Intellectual property in the Service's software, lyric/music engines, templates, and design belongs to the Company or its rightful licensors. ④ Whether AI-generated Results qualify for copyright protection follows applicable law and precedent; the Company makes no warranty thereon.
Article 8 (Storage and Deletion of Content)
① Results and uploads are retained only for 48 hours after generation for delivery purposes, then automatically deleted. ② You may request immediate deletion at any time during this period, and the Company will process it without delay. ③ Recovery is impossible after automatic deletion, so please download your Results within the retention period.
Article 9 (Limitation of Liability)
① The Company does not warrant the quality, accuracy, completeness, or fitness for a particular purpose of AI-generated Results. ② The Company is not liable for delays or interruptions caused by force majeure or by failures of third-party AI, music, email, or cloud providers, absent the Company's intent or negligence. ③ However, if Results are not generated due to the Company's system or an external engine failure after payment, the Company will re-generate at no additional cost or refund per the Refund Policy. ④ The Company does not warrant uninterrupted or error-free service.
Article 10 (Changes and Suspension)
The Company may change or suspend all or part of the Service for operational or technical reasons, with prior notice for material changes. No separate compensation is provided for changes to features offered free of charge.
Article 11 (Eligibility and Age)
The Service is available only to those aged 14 or older. Children under 14 may not use the Service, and the Company may restrict use found to be by a person under 14.
Article 12 (Governing Law and Disputes)
① These Terms and use of the Service are governed by the laws of the Republic of Korea. ② The Company and users will resolve disputes in good faith; failing agreement, the Act on Consumer Protection in Electronic Commerce and other applicable laws and customs apply.

🔒 Privacy Policy

1. Personal data we collect
We collect the minimum necessary to provide the Service: · (Required) Email address — to deliver results and verify the recipient · (Required) Photos/videos you upload — to create the slideshow video · (Required) Topic, mood, and other text you enter — to generate the song and lyrics · (Automatic) Payment-related data handled by the payment processor, usage records, access logs We do not store payment instrument details (e.g., card numbers); these are handled by the payment processor.
2. Purpose of collection and use
· Generating Results (song/video) and delivering them by email · Verifying the recipient and managing usage counts (e.g., discounts) · Improving service quality and statistical analysis · Meeting legal obligations and handling disputes
3. Retention period
① Results, uploads, and email-matching data are automatically destroyed 48 hours after generation. ② However, transaction and payment records required by laws such as the Act on Consumer Protection in Electronic Commerce are retained for the legally mandated periods: · Records on contracts and withdrawal of subscription: 5 years · Records on payment and supply of goods: 5 years · Records on consumer complaints or dispute resolution: 3 years
4. Processing entrustment and third parties
We entrust processing as needed to provide the Service, and not for any other purpose: · AI lyric/song generation: AI processors such as Google (Gemini) and KIE (Suno) · Result notification emails: Resend · Server/storage infrastructure: Google Cloud Platform · Payment processing: Korea PortOne Co., Ltd. (PortOne — payment integration processor) and payment gateways (KG INICIS, PayPal, etc.) We do not provide personal data to third parties except as required by law or with your separate consent.
5. Overseas transfer
In using the above AI, cloud, and email services, your inputs (email, photos, text, etc.) may be transferred to and processed on servers located outside Korea. The items transferred are as in Section 1, at the time of your generation request, for the purpose of generating and delivering Results. Your consent to this Policy constitutes consent to such transfer.
6. Your rights
You may at any time request access to, correction, deletion, or suspension of processing of your personal data. Results/uploads are auto-destroyed within 48 hours, but you may request immediate deletion at earth808music@gmail.com beforehand, and we will act without delay.
7. Destruction procedure
Personal data whose retention period has expired or whose purpose has been achieved is destroyed without delay. Electronic files are permanently erased by irrecoverable means.
8. Cookies
We use the minimum cookies necessary to provide the Service (e.g., language setting, access handling). You may refuse cookies in your browser settings, though some features may then be limited.
9. Notice regarding input topics
The topic and mood you enter are used to generate your song and may be used, in a non-identifiable form, for service-quality improvement and demand analysis (statistics). Please refrain from entering personal or sensitive information (names, contacts, etc.) in the topic field.

11. Duty to notify

💳 Refund & Cancellation Policy

1. Nature of the digital content
The songs, lyrics, and videos provided are made-to-order digital content generated individually and immediately upon payment, according to your order (topic and options).
2. Limitation of withdrawal
Under Article 17(2) of the Korean Act on Consumer Protection in Electronic Commerce, withdrawal of subscription (refund) is restricted for digital content that is individually produced to your order once generation (work) has begun. The Company discloses this on the checkout screen in advance and proceeds only after obtaining your consent (checkbox). Your consent is deemed consent to the restriction of the right of withdrawal.
3. When refunds are available
Refunds are available when: 1. Generation has not started after payment; 2. Results are not generated due to the Company's fault, such as a system or external engine (AI/music server) failure — in which case you may choose between free re-generation or a full refund; 3. The delivered Results materially differ from what was described or advertised.
4. Refund procedure and timing
① Request a refund at earth808music@gmail.com; the Company processes it after verifying the facts. ② Refunds are made to the original payment method and may take about 3–5 business days depending on the payment processor. ③ Late-refund compensation may be added as required by law.
5. Disclosures and consumer protection
Matters not specified here — the period, method, and effect of withdrawal, and the conditions and procedures for refunds — follow the Korean Act on Consumer Protection in Electronic Commerce, related laws, and the Consumer Dispute Resolution Standards.
